SC Instructs Child Care Institutions To Register: What Is The Procedure

The Supreme Court strictly instructed the child care institutions to register themselves officially. The matter is directed to be listed by July 11th, 2018. In May, last year Supreme Court passed an order to register the institutions but it stayed only in papers. Thus the court directed strictly with a time limit to get the registration procedure done. The Ministry of Women and Child Development is directed by the Supreme Court to ensure that individual child care plans are just on paper, nothing in action. The bench of Justice M.B. Lokur and Justice Deepak Gupta was informed that though there was a direction passed by the court last year regarding individual child care plan, it was not implemented properly.

It has been pointed out that plans for utilization of funds under the Integrated Child Protection Scheme (ICPS) had not been submitted yet. Additional Solicitor General Mr. Mahinder Singh informed that communications have been sent and the plans have been received for utilization of the funds by the State Government and Union Territories’ Administrations. The Project Approval Board is likely to meet in April to look into the plans which are submitted and their viability shall be examined. The Court directed the matter to be listed on July 11th 2018.

The registration process of the child care institute involves the following procedures:

  • You have to download the Form 27 and fill it and submit it to the state office of child care
  • At the time of registration, the State Government shall determine and record the capacity and purpose of the institution and shall register it as a children’s home, open shelter, specialized adoption agency, observation home, special home or place of safety. It shall be approved or canceled within one month period.
  • If the Government does not issue a provisional certificate within one month, the receipt of such application can be treated as the provisional certificate for maximum six months.
  • The registration shall be valid for a period of 5 years and shall be subject to renewal.
