The Uttrakhand High Court gave a suggestion that state legislatures to enact Freedom of Religion Act to curb and end the sham conversion of religion only for doing inter religion marriage.
Justice Rajiv Sharma stated that nowadays there have been lot of instances of inter religion marriage and in few cases it can be noted that the conversion of religion is only sham just to facilitate the marriage. Thus, it is advised to state government to enact a Freedom of Religion Act on the same lines of Madhya Pradesh Freedom of Religion Act, 1968 and Himachal Pradesh Freedom of Religion Act, 2006 so as to put an end to sham religion conversions without hurting religious sentiments of people. The court justified its suggestion in light of fast changing social norms.
The Writ was filed in the case of marriage of Mrs. Urja Sharma with Mr Adil Hussain Ansari aka Atul Sharma. The conversion of Mr Ansari to Mr Sharma was the question in dispute before the court. The court has to see whether the conversion from Adil to Atul has been done solely for the purpose of the marriage or is done for every other purpose as well.
The Court has held that the disputed question is a question of fact which can be determined by competent court of law separately.
