What are the requirements for one sided divorce

1.How to apply for one sided divorce ? 2.Under what circumstances one can appply for one sided divorce ? 3.my mom wants a divorce from my dad on the grounds of cruelty and he donot allow my mom to live on her own will 4.would u help me to resolve this issue ? 5. And also my mom doesnot want any propery or cash from dad 6.and we are 3brothers and we all are with our mom

The divorce always is filed by one spouse against another , and on service to the other party and his/her failure to be present the case will be heard expartee i.e in absence of the other spouse. if there are sufficient grounds and evidence available the court shall grant divorce. such a divorce can be said to be one side else there is no such thing called one sided.

Contact a local lawyer and ask your mom to file the divorce. You 3 brothers can be the best witness to prove cruelty against your father. Even if your mom does not want any alimony, she is entitled for the same and she can claim along with alimony for minor children and in DV proceeding, you can claim for separate residence.

Wife provided wrong/incomplete details in income affidavit

Hello experts, I am contesting a maintenance case against my wife. In her income affidavit(Rajneesh vs Neha format), she has not stated true facts - she hid some facts and lied on some facts. Below are some examples - She was gainfully employed(not working now), but she hid her past work experience - She claimed that her monthly expenses are more than 3L per month but did not provide the details of her expenses - She mentioned that she took 7L+ loan but provided no details - She inflated my salary and alleged that I own ancestral property worth 80L, even though I don't have any property on my name Based on this, can I file objection in court with my proves and initiate perjury case against her?
